Abstract:
Compared with the traditional copyright environment, technological progress has made great changes in the transmission way, utilization way and profit mode of works, so encouraging innovation as the value goal of copyright protection should receive more attention. Setting copyright filtering obligations hinders information flow, overrides user rights, goes against market logic, and is inconsistent with the actual demand of current network copyright protection. In the context of open innovation, gaming and cooperation coexist in online copyright protection, so we should clarify the boundary between “can be” and “should be”, and build a cooperation mode of copyright filtering. Copyright filtering should be regarded as a voluntary choice of Internet service providers, which should be regulated by the market.
