From ChatGPT to DeepSeek: Challenges and Implications of Large Models to the Legitimacy Theory of Copyright

  • 摘要: 随着大模型从ChatGPT到DeepSeek的技术升级,在汹涌的生成式人工智能浪潮冲击下,著作权领域的创新方式、创新内容乃至创新主体都受到了一定程度影响。著作权正当性论证是关于权利前提的一种反思,旨在证明著作权制度设计的理论基础。受制于理论的固有缺陷和不适应性,传统的著作权正当性理论在用于人工智能生成内容的著作权保护论证时显得力有不逮。无论是洛克的“劳动论”、黑格尔的“人格说”,还是建立在边沁功利主义思想上的“激励论”,都存在着难以克服的现实梗阻。为更好地实现《著作权法》的立法宗旨,不对人工智能生成内容采用著作权保护,转而将其置于公共领域的做法,或将成为生成式人工智能时代著作权制度困境的纾解之道。

     

    Abstract: With the technological upgrade of foundation models from ChatGPT to DeepSeek, under the impact of the surging wave of generative artificial intelligence, the innovation methods, contents and even the innovation subjects in the field of copyright have all been affected to a certain extent. The justification of copyright is a reflection on the premise of rights, aiming to prove the theoretical basis of the design of the copyright system. Constrained by the inherent flaws and inadaptability of the theory, the traditional theory of copyright legitimacy appears inadequate when applied to the argumentation of copyright protection for artificial intelligence generated content. Whether it is Locke’s “Theory of Labor”, Hegel’s “Theory of Personality”, or Bentham’s “Theory of Motivation” based on Bentham’s utilitarian thought, there exist insurmountable realistic obstacles. To better achieve the legislative purpose of the Copyright Law, not adopting copyright protection for the artificial intelligence generated content but instead placing it in the public domain may become a solution to the predicament of the copyright system in the era of generative artificial intelligence.
