On the Study of Merchandising Right

  • 摘要: 商品化权是将能够创造商业价值的虚拟角色、卡通形象、影视作品片段等进行商业性使用的独占权利,是对已有智力成果的再次利用,系为应对著作权、商标权制度在调整商品化活动中所暴露出的不足而形成的新型知识产权。与传统知识产权相比,商品化权具有权利保护的被动性、权利界定的事后性等特征

     

    Abstract: In order to avoid the unlawfully commercialized using of the spiritual production from non-obligees, merchandising right was constituted under the Tenet of Equity. Merchandising right as well as copyright, trade mark right and patent right will establish a whole legal system concerning intellectual property.
