摘要: 从传统的形式论，到引入的实质论，再到融合后的二元论，不纯正不作为的义务来源理论发展到了一个新的阶段。目前的二元论存在不少问题。重构后的二元论应当包括表现形式与产生根据两个方面。表现形式不应当考虑事实性因素，且应当是一种开放式的结构；产生依据同样不应考虑事实性要素，作为义务的实质产生根据是对法益的社会功能关系；两者之间的关系应当是以产生根据为主，以表现形式为辅
