Abstract:
Judicial activism stems from economic and social development needs, which requires the judge beyond the traditional passive and neutral role, and actively uses judicial power to protect the legitimate rights and interests of citizens to respond to the social reality. China’s judicial activism (ie, active justice) not only attendants the current socio-economic development, but also has deep local roots. Therefore, fully exploiting the beneficial factor of tradional legal culture contributes to the unity of legal effect, political effect and social effect of judicial decisions, thus contributes to achieving the essential purpose of socialist justice.
