对进一步加强职务发明人权益保护的思考 ——兼论《职务发明条例草案(送审稿)》的修改及完善

Thinking on Further Strengthen the Protection of Employee-Inventor’s Rights ——Proposed Content for Modification and Perfection of Draft Regulations on Service Invention

  • 摘要: 为了更好地保障职务发明人的利益,《职务发明条例草案》(送审稿)欲寻求一条用人单位与发明人利益平衡的和谐发展之路。草案(送审稿)以进一步明确职务发明的界定为突破口,在遵循现行法律法规和有关司法解释的立法精神基础上进行了一些创新,如允许“主要利用本单位物质技术条件”完成的发明在归属方面存在例外,增加了发明报告制度及处理职务发明的不同方式等。在此基础上,进一步建议将“约定优先”适用于所有的职务发明,同时明确规定禁止事先约定非职务发明的归属;建议职务发明报告制度的设计要符合我国具体情况;建议完善与单位对职务发明处理方式相适应的奖励报酬制度。

     

    Abstract: In order to better safeguard the interests of the employee inventor, Draft Regulations on Employee Invention want to seek a balance between the employer and the employee. Following the current laws and judicial interpretation, the draft makes some refinement and innovation on the system of employee invention. Without doubt, this is a draft of great significance. At the same time, we should also see the imperfections. We suggest "the priority of agreement" should be used in all kinds of service inventions, and the draft should prohibit employer get the non-service invention by prior contract; the inventors have the right to get rewards no matter what way the service invention is used ; the design of reporting system must suite to China’ national conditions
