Research on Legal Supervision of Crowd-funding for Personal Salvation

The promulgation of the Charity Law in 2016 makes up for the legal gap in the field of charity in China, but at the same time, it also separates personal salvation from charity, making personal salvation, especially crowd-funding for personal salvation, a grey area without legal supervision. In recent years, with the development of China’s Internet crowd-funding industry, some public welfare crowd-funding platforms have emerged. Individuals who have difficulty in living due to major diseases can receive donations through crowd-funding to continue to treat and maintain their basic livelihood. However, due to the lack of clear provisions in our law on crowd-funding for personal salvation, such crowd-funding activities are mixed with many fabricated facts and exaggerated facts of the phenomenon of fraudulent donation. Some people with ulterior motives regard crowd-funding for personal salvation as a way of making money, consuming the love and sympathy of the public. This paper clarifies the legal nature of crowd-funding for personal salvation, clarifies the legitimacy status of crowd-funding for personal salvation, and proceeds from improving relevant legislation, the full cooperation of civil affairs departments and social organizations, and strengthening the supervision of the use of charitable funds, so that crowd-funding for personal salvation can play a better role under a reasonable and effective regulatory mechanism and benefit the people in need.
