Abstract
Purpose/Significance In recent years, mobile payment has become the most popular payment method due to its convenience and efficiency. In this activity, consumers use mobile devices to reach agreement with mobile payment service providers to accept the services they provide, which involves contractual relationships, and bad contractual relationships may lead to consumer rights violations. Due to the limitation of adjustment objects and methods, the regulation of private law is not enough to make an effective response. Design/Methodology Based on the definition of the characteristics and types of mobile payment service contracts, the analysis shows that the signing of non-standard mobile payment service contracts will increase the user’s data risk and impact the user’s property security. Findings/Conclusions In order to control risk, protect the interests of the consumers’ trust, save the judicial cost, reflect the special mission of such contracts, mobile payment service contract shall be included in the core object of regulation, Legislators and regulators should fully improve the registration system, cultivate the consumer risk awareness, unify data standards, regulate the conclusion and content of such contracts moderately.
