Theoretical Foundations and System Reform of Rights Protection of the Relatives of the Accused

The rights protection of the relatives of the accused are not paid much attention by Chinese Criminal Procedure Law. Actually, Chinese Criminal Procedure Law should treat them seriously, for there are thick theoretical foundations on the rights protection of the relatives of the accused. Though the new Criminal Procedure Law has made progress, some obvious shortcomings can also be seen on the rights protection of the relatives of the accused. Chinese future Criminal Procedure Law should transform ideas and perfect some key systems, including the right of visit, substantive counsel and the real right of refuse to testimony of the relatives.
