我国负面清单制度改革:基于上海自贸区的实践

Reform in China Negative List: Based on Practice of Shanghai FTA

  • 摘要: 负面清单制度是行政审批制度的新形式和改革突破口。上海自贸区负面清单制度更是积累了先行先试的若干可复制可推广经验,表现出穷尽性、前瞻性、双向指导性和待遇公平性等特征,并具有规范政府行政行为、界定行政审批边界、倒逼政府简化行政审批职能等作用。上海自贸区负面清单于2013年9月正式发布,2014年7月做第一次修改。但仍存在内容繁杂、表述清晰度不足,法律地位不明确等自身缺陷;以及辐射范围狭窄、行政管理方式陈旧和配套制度不完善等问题。目前上海自贸区负面清单仍处于探索和改进阶段,需要进一步提高文本质量;消除负面清单“形式化”的嫌疑;保证未来产业安全和经济安全,实现负面清单的动态管理;完善配套实施细则,提高行政管理透明度等。

     

    Abstract: Negative list system is a new form and reform breakthrough of the administrative approval system. Shanghai FTA negative list system is the accumulation of a number of experiences which can be replicated. Its features is exhaustive, prospective, double guidance and treatment with fairness, which regulates the behavior of government, defines the boundary of administrative approval system, and forces the government to simplify its administrative approval functions. Shanghai FTA' negative list was officially released in September 2013 and modified in July 2014. But there are many questions, such as content complication, lack of expression clarity, and unclear legal status; its radiation range is narrow and the administrative management modes and supporting system and not perfect. At present, Shanghai FTA negative list is still in the exploration and improvement stage, therefore the quality of the text needs to be improved, the negative list “formal” suspicion should be eliminated, the security of the future industry and economy be guaranteed to realize the dynamic management of the detailed rules for the implementation of the negative list, and the matching rules be perfected to enhance the administrative transparency.
