经济新常态背景下工资集体协商制度的优化:国家的视角

Optimization of Collective Bargaining System on Wage Under the Background of Economic New Normal: From the Perspective of the State

  • 摘要: 在当前中国经济逐渐步入新常态的背景下,劳动关系领域的矛盾冲突有所加剧,这就需要发挥包括工资集体协商在内的劳资关系调节机制的作用。研究认为,工资集体协商在实践中的实施效果不尽如人意的关键在于国家在其中的作用发挥还不到位。因此,国家需要在工资集体协商中厘定与资方、劳方的关系并对双方进行有效的协调。国家在工资集体协商中不应再扮演主导者的角色,而应成为规则的制定者、劳资矛盾的协调者和裁判者、公共利益的维护者。面对“资强劳弱”的总体态势,国家应主要通过立法支持劳方并规范约束资方,以实现劳资之间的适度均衡,这样才能促进工资集体协商制度的优化和劳资关系的有效治理,从而为中国经济的转型升级和步入新常态提供稳定的社会环境。

     

    Abstract: Under the background that the Chinese economy has been stepping into the new normal, the contradiction and conflict in the field of labor relations have become more and more serious. Therefore, it is necessary to play the role of the labor relations adjustment mechanism, including collective bargaining on wage. This paper argues that the implementation of collective bargaining in the practice is not satisfactory and the key reason is the role of the state is not in place. Consequently, the state needs to define its relations with labor and capital, and carry out effective coordination between two sides in collective bargaining on wage. The state should not play the leading role in the collective bargaining on wage, but should be the maker of the rules, the coordinator and referee of the contradiction between labor and capital, and the defender of public interest. In the face of the overall situation of "strong capital and weak labor", the state should mainly through legislation support for the labor and regularize and restrict the captital, in order to achieve the proper balance between labor and capital, so as to promote the optimization of the collective bargaining system on wage and the effective governance of labor relations, and thus provide a stable social environment for Chinese economic transformation and upgrading and stepping into the new normal.
