脑机接口技术应用引致的著作权困境与因应对策

Copyright Challenges and Countermeasures in the Application of Brain-Computer Interface Technology

  • 摘要: 随着脑神经科学的快速发展,脑机接口技术已使得人们得以脱离身体肌肉系统通过“意念”直接控制外部设备实现内容输出。这冲击了以身体为媒介的传统作品创作模式,造成作者身份认定不清、作品适格性界定困难以及著作权侵权责任归责困难。面对脑机接口技术应用带来的著作权困境,应秉持使用优先原则,基于脑机接口使用者的事实创作意图和反馈修改行为认定其作者身份;立足“脑电信号决定论”,认定由使用者的脑电信号决定并修改调整的输出内容满足作品适格性要求;同时,根据脑机接口输出内容反映使用者大脑思想的“三类型”,区分脑电信号直接侵权型、混合信号共同侵权型以及脑机接口直接侵权型“三侵权”,进而分别进行著作权侵权责任归责。通过上述措施纾解脑机接口技术应用引致的著作权困境,从而规范脑机接口技术在文学艺术领域的有序应用。

     

    Abstract: With the rapid development of neuroscience, brain-computer interface technology has enabled people to bypass their muscular systems and directly control external devices through “thought”, thereby producing output. This has disrupted the traditional model of creative work mediated by the body, leading to uncertainty regarding authorship, difficulties in determining the eligibility of works, and challenges in attributing liability for copyright infringement. In addressing the copyright challenges posed by the application of brain-computer interface technology, the principle of “priority of use” should be upheld, with authorship determined based on the actual creative intent and feedback-driven modifications of the brain-computer interface user; grounded in the “brainwave determinism” principle, it should be recognised that output content determined and modified by the user’s brainwaves satisfies the requirements for work eligibility; simultaneously, by categorising the “three types” of brain-computer interface output reflecting the user’s mental thoughts—namely, direct infringement via EEG signals, joint infringement via mixed signals, and direct infringement via the brain-computer interface itself—we can distinguish between these “three forms of infringement” and thereby allocate liability for copyright infringement accordingly. Through these measures, we can resolve the copyright dilemmas arising from the application of brain-computer interface technology, thereby regulating its orderly application in the fields of literature and the arts.
