Abstract: In our country’s law of succession, the restriction of a free will is so confused and that the judicial department legal precedent is in a state of chaos, which makes us take the law seriously. The essay analyses our country’s relative law and regulations, points out some disadvantages in the legislation, considers that we should abolish “reservation of a necessary portion of an estate” from the article 19 of the succession law and adds “legal portion” with Chinese characteristics, in order to complete our testament succession law systems
