Abstract: There is no transfer of proof burden on the crime of holding a huge sum of property with unidentified sources.The suspect’s providing evidence to note the source of property is to fulfill entity obligation.The initial order to explain is in the preliminary investigation stage,not in the filing procedure.Only the prosecution has the power of ordering to explain which is required by criminal law.The original judgment should be maintained even if the source of property has been identified.
