Abstract: The judge is an important member of the legal professional connnunity，and the most important character of legal profession lies in the particularity of thinking mode．“Judicature”is a kind of judgment power，but the mode of judge thinking is very different from the general judgment activity，having deep professional birthmark．The thinking mode of“syllogism”type and the thinking mode of“absolute discretion”type are two kinds of extreme performance of the mode of judge thinking，but uncover the basic character of the judge thinking．We should split the difference of the two modes，and develop the thinking mode of the correctional‘‘syllogism”type．
