Abstract: Different law traditions and race mental states are the reasons resulting in a disadVantageous position to the victim in the crime litigations．In order to protect the legal rights and raise the litigation position of the victim at the maximum level，it is supposed to enhance the salvage obligation of judges in crime litigations．Therefore，we should con— struct a perfect system in salvage obligation of judges from the three aspects of fight impartation obligation，fight security obligation and right relief obligation．
